My old insurance company called me and told me that I'll be in a law suit for my car accident that happened almost two years ago. My car was hit by an 18 wheeler from the back and was demaged but got covered by the insurance.The police record stated that both cars have faults although it's so clear that I have got hit from the back and had all the damage but 18 wheeler did not even had a ding. Now.. the driver from 18 wheelers put a law suit on us because his hand was injuired and he could not work since then. I was so mad and feel like it's a scam. Please help me and tell me what should I do. thanks.

Isn't you insurance handling it? Let them deal with it, that is what you pay them for.

Are you just serving as a witness for the insurance company? Yeah, I don't know who would take on a case for someone that hit someone else - and then wanted to sue the person he hit. Bizarre.

My wife was once involved in an accident and sued by that person. We found out about it a few days after the accident. The insurance company provided us with a lawyer because if my wife lost then the insurance company would have to pay. I think my wife had to give a statement and that was it. It never made it to court. The insurance company and the other person settled out of court.


The night of accident I spoke on the phone with the other person in the accident. He said that it was nothing against us and not to worry. He said the money would come from the insurance and he wouldn't take any money from us. I thought that this was weird but didn't know what to make of it. The next day my insurance company sent someone to view his damages. He already had a lawyer. We found out about being sued shortly after that.

I agree! Starting lawsuit almost two years later is a bit bizarre. Let your insurance handle it.

How does an 18 wheeler driver get in an accident that doesn't even ding his truck, but somehow his hand is hurt enough that he can't work again? Sounds like he found a lawyer who thinks he can settle for a few bucks out of court.

Opportunists are everywhere. Not sure what the statute of limitations is on that but it seems like he just slid in before the end date.

There must be more to the story if the policeman found fault with the OP -- and that's probably the basis for the lawsuit.

And I agree that it'd hard to imagine how the driver of the 18-wheeler could have hurt his hand so badly that he can no longer work at any job.

I will never understand why people sue for "accidents." They are accidents!!! Accidental!!

I believe in Karma. That 18 wheeler driver could easily cause another accident, a bad one, where someone is severely injured or worse. That person will have a choice, sue, or be a decent human being. I hope karma gets him.
