Moving within texas. I received two estimates by one firm, binding and not to exceed. However there is a surcharge/flat fee if I take not to exceed, which is 15% of the binding estimate. Is this legal? Anyone ever encountered this before?

This. I'd give them two offers:

1) 15% off the originally quoted price, or

2) Find a new customer.

There are countless moving companies out there, find one that's not making you pay more for a promise not to *********.
