The methodology used in the appraisal report you purchased is also an important factor here. If it was made up from some sort of formula or algorithm, not only will a judge be unable to understand it and its relation to real-world diminished value, insurance supervisors will tell you to go ahead and litigate because they know your diminished value report is crap.

You could schedule a mediation at the Harris County Dispute Resolution Center for free. At mediation a neutral will try to help you settle the case on acceptable terms to both sides. Without going into too much detail.

Went into mediation and the person felt the insurance's offer was very fair.

After settling the case, found out the mediator is good friends with someone in the insurance company.

Gave it my best and lost. Had a feeling this would be the case going up against the big boys. The accident that wasn't my fault ended up costing me thousands.

What I would do differently if this happened next time is find a DV appraiser that will appear in court. If they are not present, their report holds no weight. The second thing is have a trial by jury.

This case was initially a trial by jury, but got changed last minute to a bench trial. I think that having jurors vs a judge would hold less bias and conclude to a fair settlement.

There were other cases in trial and they all settled. No one went into trial.
