Default 09 Tax Appraisal Protest- Age of comps

I am north of Houston in Montgomery Co. Can anyone help me with a simple question on tax appraisal protest? Of the comparables given me by the County, none were sold between June 30, 2008 and Dec 31, 2008. A CMA from realtor friend also confirmed that there were no comparable sales in that time frame. There were houses for sale at that time. My contension is that the economy is to blame for no sales and the county has no justification for an 8% appraisal increase on my house because they are not using current data. Generally realestate agents would not consider sales data over 3 months old to have much validity on appraisals. Can I beat the tax man with this argument and, if so, is there any supporting info that might help me? thanks in advance.....Greg
