Counties in Alabama don't have home rule powers, and are largely powerless to zone and control land use.

Cities and towns do have land use powers, so that's why Gurley went to extraordinary efforts to have the legislature pass an annexation bill for the quarry proposed in the prior decade. The town was able to get the property annexed before the operation got started. Vulcan ended up buying that site, not sure why.

In this case, the quarry has already received its state approvals and seems to be ready to operate. Not much anybody can do at this point except to buy it out or sue it for being a public nuisance.

Yeah, but when foundations start cracking.....who pays for that?

Good question. Insurance will always try to weasel out, and I would think you can't sue the city or county since they didn't have the power to stop it.

I guess sue the state (good luck with that) or sue the quarry:
