I hardly think it is discriminating. An employer doesn't want to go through the whole interview process and hire someone only to find out later that they aren't authorized to work in this country. It is a waste of the employers time. It just makes sense to ask right up front IMO.
Then as I stated - they need to ask EVERY applicant, not just ones they assume are migrants

My husband, who is white, just had to show NUMEROUS documents to get his DL renewed. He wasn't thrilled about it but it was what he had to do. I am so tired of all these racists forcing us to show documentation in order to enjoy the privelidges of this country.
My current job required my driver's license, fingerprints, urine analysis, and a background check. And they are complaining about showing their green card? Give me a break, retards.

My last job required all of the above including a credit check.
Like it or not, the law prohibits discrimination on the basis of national origin. If an employer requested a green card during the interview process, a candidate who is not hired could claim discrimination. I know a manager who made the mistake of asking a heavily-accented candidate where they were born. The person wasn’t hired, and claimed she was discriminated against due to national origin. It resulted in a nasty litigation. There are certain questions and documents that are simply off-limits prior to employment.
