Before this year, Phoenix-area community colleges asked legal immigrants to show a green card before hiring them. The Justice Department calls the policy 'document abuse' and seeks damages.
I am beginning to hate lawyers, and judges
are moving down the list too.

I think what is being said is that the employer can't ask to see one's green card before hiring them but they have to ask them for it after they hire them. Seems stupid to me. What is the difference? The difference is that the employer has to go through the whole interview and application process which is a waste of his time if afterwards he finds out that the applicant isn't even authorized to work here.

You are absolutely correct. What happens is, if they even suspect
the applicant may be illegal, they don't offer them the job. So the
guy that is legal doesn't get one too. A stupid, catch 22 situation.
Polititions (lawyers) are the only ones who could think that up.

Doesn't say much for the white house when they display that kind of logic.
The colleges have basically admitted the offense. They stopped doing it last January. The issue is a fine or other actions to fix the damage done.
The trick here is that no one is required to show a green card and many legal immigrants don't have one.
If you look at the back of an I9 it shows what is required for proof of residence and the right to work. It takes a driver's license and an SS card. There are other combinations that don't require a green card.
The college's got in trouble because they failed to follow the law and demanded a green card from some while taking a DL and SS card from others. Note that many Americans would have only the DL SS card combo.
This official stance has already been discussed on another thread in this forum. Basically it's discriminatory to ask SOME applicants to provide one form of ID but not others.
The I-9 is quite clear on what documents are acceptable. I do agree however it could be a catch-22 for legal immigrant job seekers, but then they probably wouldn't been offered the position anyway if the hiring staff are that brain dead. HR personnel are SUPPOSED to know the rules - I'm stunned how often they don't.
