Why hold them in detention? If they are illegal send them home! Damn, it's so simple. No lawyers needed, no trial - you are either here legally or illegally.
Denied access to "legal aid groups" don't they mean "illegals advocacy groups" ? They HAVE access to immigration attorneys provided by THIS country - and that's ALL they're entitled to.
They should think themselves lucky they even GET a hearing and aren't just loaded straight onto a "trip home"
I really don't see how this can be such an issue. I guess I don't understand. It seems black or white, legal or not. Are there other issues that come into play? Im not being facetious, I really don't know. It seems as if it would be cut and dried and a 5 minute hearing would solve it. Am I naive'?

No you're not naive. Actually the problem is you have common sense, something the Government is lacking.
They could choose voluntary departure and be home in hours. Instead they demand free lawyers and court hearings so stay in detention centers.
What they want is easy quick citizenship and all the government handouts that go with it.
