What you failed to illustrate is by what means this could be done. Simple Congressional legislation will not sufice. Court Case? if it is brought for arguement before the Court...maybe, if it could be shown how a plaintff is harmed by the rulling as it stands today.

The debates and records from the past are all on file for the Supreme Court to read and re-analize. 'AND" subject to the jurisdiction thereof is a good starting point.
