E-verfy was established in 1997 and is still a voluntary for employers to use.
I guess you missed it then. As right from the beginning in this topic it was noted that Whitman had gone through an agency to hire Diaz. Regardless of whether or not e-verify was used it was still up to the agency to determine Diaz's authorization to work in this country.

E-verify began as the Basic Pilot program and it's use was restricted to 5 states. It was only expanded as E-verify to all 50 states as E-verify in Dec '04. (just ftr)
Currently it IS mandatory in quite a few instances - such as federal contractors.

It is also required for all employers of 15 or more employees in Arizona, South Carolina and Mississippi.
