I would agree to have them locked up. Only if the false papers are not recognizable from the real ones, than I would give them a pass...but to me there is enough to proof if they are legal or not. Also illegals need to be locked up, since they already have broken one law and probably more than one...Working with false papers is already a 2nd or 3rd offense!
