In California they cannot sue for excessive damages if they are not insured regardless of legal status. Elsewhere it is different.
I have known several people that have had their cars totalled by Illegals and the Illegals paid nothing to them.
You can always declare Bankruptcy so I would have to say unless it was caused by a deliberate criminal act on your part Chapter 7 BK will protect you from losing "everything".
It's not just Illegals, in California you can and will be sued by anyone for almost anything imaginable.

i am really worried now, its bad enough that I'd have to pay for my own repairs but now get sued
Why do people take advantage of other people?

I added the no insurance part...but in Texas that happens whether the person is legal or not.
If you want to change the law, make it that no person...legal or not...can sue you if they do not carry auto insurance. See if the Insurance companies go for that.
I also added the uninsured part....hopefully it will help. One of my employees family member hit another car and although this person was here legal, they were uninsured and a lawyer couldn't help her either.
They tried to claim that IF that other person who had no license, had not been in a car than this accident couldn't have happened...but it didn't work since she was at fault and not the other party...to me something is wrong...
