It's a civil penalty. There is no argument towards undocumented immigrants that's not based on bigotry
I don't know how it can be bigotry when you compare the people who are just coming to this country and staying with no documentation with the honest people who complied with the law and and went through the long and tedious job of immigrating legally through the system.
You probably don't realize that the people who came here legally had to submit birth certificates, long and detailed applications in triplicate, find a sponsor who would promise to support them so they don't end up on welfare, go through a criminal background check, receive several vaccinations, get a detailed medical checkup, be interviewed at the consulate, and wait a long time for all this paperwork to be processed. Oh, also there is a large fee every time they submit packets of paperwork.
It's not an enjoyable and quick process yet these people do it because they are honest. So is overstaying a visa or just driving or walking in without having gone through the process fair to those who are waiting in line, doing it the right way, complying with the law?Talk to anyone immigrant who came here the right way and see how THEY feel.
It's not racist in any way, it is NOT FAIR. And maybe we don't want anyone coming here permanently who has NOT had their background checked! Also anyone who has not been checked for TB or other communicable diseases. What does that have to do with a person's race?
Ironically, I would have to say there is something to that. State governments as well as the Feds approach it in a rather schitzophrenic fashion. Illegals are welcomed with a wink and often given benefits. They have been designated a victim class by many with associated sympathy.
I reckon "Decriminalized" would be the best term. Illegally coming to and residing in the USA is akin to smoking hash in the Netherlands. Its not technically legal, but there is little in the way of penal ramifications should you choose to do so.
They don't have to be treated like hardened criminals, they need to stop being given rewards like food stamps and free health care just for showing up, they need to be returned home.
They also need punishment that fits the crime. If they are found to be here illegally, they need to be quickly deported and barred from legal reentry, legal residency and citizenship permanently.

Well that is not going to happen. Like it or not, enough people see no problem with an open borders policy.
If you and I turn out to be right, they will come to their senses and limit the damage. If they are right and its all hunky dory, then you and I have nothing to worry about and can happily admit we were wrong.

It is only some of those in power that see no problem with an open borders policy, not loyal, lawabiding Americans.

Agreed! What does desiring that immigrants respect our immigration laws and come the right way and for our laws on that to be enforced have to do with bigotry?
Are you serious? There are TONS of arguments against illegal immigrants that having nothing to with "bigotry!"
From wage deflation, to resource depletion, exploitation of social services, to population growth difficulties, to degredation of neighborhoods, to strained healthcare systems, to increase in crime and gangs.... if you don't think there's "arguments" against illegal immigration that have nothing to do with the ethnicity or origin of the immigrants, you AREN'T PAYING ATTENTION!
The pro-illegals throw out any viable arguments against illegal immigration because they have none themselves to support their positions. So they throw out the race card. It is a well known tactic by them and we have seen it countless times right here in this forum.
It's impossible to prove they crossed the border. Do you even know that most undocumented immigrants are visa overstays?
According to statistics, 40% are overstays - where is 40% of 100% most? If they're EWI then they entered illegally. Hard to argue with facts isn't it?
