They actually could if they can prove to be the legal guardians... it seems the grandmother finally did that, or at least what she did to get the child back from Mexican authorities...

The grandparents can request for married sons & daughters as third category family migration, however this can take a very long time as I remember there are 23,000 visas for this category per year, so a long line has already been formed in this one... Also, as the parents are illegally in the US which can complicate things...

Yes, the method you mention is extremely long wait times, and directly the I-130 specifically excludes sponsoring grandchildren. To be custodial, the relationship would have to be established by adoption. Agreed, the parents illegal present in the United States, still alive, would complicate it to almost certain impossibility.

International adoption rules became more standardized for the U.S. a couple years back by signing on to an agreement, but the process is drastically changed from what it was before...

The grandparents could have tried legal channels by declaring extenuating circumstances. Ideally, the parents should have returned to their native country to stay with their child until such a time as they could have applied to legally enter TOGETHER! As a minor child she would have been included on the paperwork with the parents.

What a disgraceful mess these irresponsible parents create for their children.

It does take a while for it to process (6 years I believe)... maybe extenuating circumstances make a difference, I don't know. But sending the child alone is in fact an extremely bad decision...

I am agreement with you about anyone attempted to be smuggled across, especially an unaccompanied child. The cartels abuse migrants horribly, and ultimately they are used a distraction while drugs are taken through another route. There is nothing to excuse these "parents" for what they put their child through.

As noted, the grandparents being U.S. citizens doesn't provide a quick immigration path for their adult married children, nor any grandchildren. Separately the granddaughter is not able to be sponsored by them, claiming "extenuating circumstances" or not. A comparable case would be Noe Aleman, whom attempted to sponsor his teenage nieces into the United States.

Irony being that he was a Border Patrol agent at the time. His case was spun as a comparison to Ramos and Compean, like he was being improperly prosecuted for the situation. Delve into the matter, and find that he correctly was given jail time for fraud.

Many of these illegal aliens desert their children in the homeland. Or bring them here only to have them live a life of lies and when they reach adulthood it's even worse for them. Makes one wonder why anyone would be an advocate for these illegal aliens, doesn't it?

So, violating the laws of a sovereign nation -- including illegal entry, deliberately overstaying visas, ID theft, fraud, driving without a license, rape, murder, and pedophilia, is simply “doing what they think is best for their family given their conditions?” I suppose they fleece U.S. taxpayers for the betterment of their families as well. As for their “conditions,” they are treated far better than many U.S. citizens, both past and present, notwithstanding their illegal status. Furthermore, if they don’t like the conditions in this country, they are free to leave.

There are illegals who won't do this, and just continue sending money home. That's not good either, the parent should be home raising the child but at least they care enough about their child to not turn them over to these horrendous criminals and have young girls traveling alone.

By allowing this family to get by with it will only encourage others to do the same and puts more young children at great risk.
