How can one use the constitution "against" you?
I guess if you consider making a "claim" as freedom of expression...I guess you're right.

Its important to see how you parced your answer...in saying that illegal aliens do not enjoy the ..."exact same rights as citizens do" means that you understand that not all rights are held only by citizens; and significant rights are afforded all persons regardless of citizenship.

This fact is drilled into local law enforcement participating in federal programs such as 287(g). That some state and local law enforcemnt write their own policing procedires does not negate rights afforded to all persons by the US constiution.

When it comes to law enforcement and immigration, we are not talking about Freedom of expression and right to address grievances...were talking Right to Due Process, Unreasonalble Search and Seizure, and The right to be secure in ones person and property.

Its true that illegal aliens are not afforded many rights as citizens, but all persons are afforded these rights UNTIL a determination of status has been confirmed. No non-federal law enforcement agent or agency can do that "in field". Congress has given federal immigration agents great leeway in dealing with suspected aliens, but has not conferred that ability to local law enforcement...even those participating in the 287(g) program.

Its simplistic to think that the US Cosntitution works for illegal aliens, what is true that it works for all persons regardless of citizenship. This means that persons here in the US on business, tourism, work[legal visa], school, or even illegally, are afforded protetive rights.

And, NONE of those rights include theft, fraud, rape, or murder.
