I was having a debate with a friend and we came to an intresting conclusion, that Border Patrol should become a millitary branch keen to the Coast Guard and with similar training. They would receive better funding if they were a millitary branch and there would be less corruption problems. Or we could eliminate Border Patrol altogether and make the job of the Army National Guard to patrol the boarder. So what do you think?

NOOOOOOOOOO........

If they became part of the military then under law they could no longer protect our borders.....

Why do you think you don't see the Marines or Army defending our borders?

America can only use it's military to protect OTHER countries borders from illegal alien invaders

Then the Militia Types would be crying Posse Commitatus. That is exactly the reason they are NOT Military

The coast guard is an agency under DHS, just like the U.S. Customs and Border Protection.

Correct, before the DHS agency merger it was under the Department of Transportation (and the never-implemented plan of being under the U.S. Navy in wartime)...

They also do some customs enforcement work...

I think thats an interesting proposal but I would take it one step further. Lets stop occupying other countries, bring our military home and use them to provide national defense along our Southern Border.

I'm not advocating martial law or using military personnel to provide law enforcement services against american citizens. I'm advocating using our military to protect our borders from illegal immigration or border encroachment.

As I suggested on another thread, I support absolutely locking down our border but at the same time faciilitating the movement of people between our countries legally. I don't mind Mexican Nationals contributing to our economy, but they need to be under some kind of legal status with some restrictions:

1. They are foreign guests/workers etc., not residents or citizens
2. They are not eligibile for social programs paid for and allocated for our citizens unless certain conditions are met
3. They are not eligible for citizenship unless they apply via the same process applied to current legal immigration
4. Children born in this country to legal guests/workers are not automatically granted citizenship

Just brainstorming . . .

Agreed entirely.

Even better: combine the Coast Guard and the Border Patrol into a single branch called the US Border Guard Service. As with the existing US Coast Guard it's personnel would continue to have military status. Only certain CG personnel have law enforcement status and they have to undergo special certification - this would continue.

No need to brainstorm, there are more than enough laws and regulations already on the books covering immigration....

About the only brainstorming needed is to determine if America is being invaded, and if so the use of lethal force to defend it's borders.

As I posted earlier it is currently illegal for America to deploy it's armed forces (Army, Navy, Marines Air Force) on the border....

As it stands today America's armed forces can only protect OTHER countries borders....

Posse Comitatus Act and the US Military on the Border – How the Posse Comitatus Act Limits the Use of US Military Forces in Border Security

Make the Border Patrol a military outfit and by law they would immediately be pulled off the border leaving no protection whatsoever against the illegal alien hordes.

Maybe it's time for Congress (under The Posse Comitatus Act) to authorize the use of military forces to secure our borders and protect the United States from the invasion that has been occurring on it's southern borders these past few decades....

The Supreme Court has ruled that the military can serve on the border. You will also notice that the US Army WAS the border patrol until the US Border Patrol was created in 1924 - that was 47 years after Posse Comitatus.

Also, Congress can pass an exemption like they did for the US Coast Guard and the Joint Special Operations Command.

Sorry, no I didn't notice something that occurred back in 1924 as it has no bearing on events unfolding today.....

All I remember about 1924 was that Adolf Hitler was sentenced to 5 years in jail that year.......
