Since Texas does not recognize gay marriage the guy goes the same way as any other illegal alien....

He was illegal for years before he got married.

I think their case should be handled the same way a heterosexual couples' would be, which is he will likely be deported back to Costa Rica to sit out a ban.

But otherwise, unless interpretation changes for USCIS to recognize gay marriage, he will not be able to come back legally (based on the relationship at least) after a ban. He wouldn't be able to qualify for a visitor's visa (B2), because his marital relationship is viewed as "immigrant intent" (in other words, he would likely "overstay"). The case won't be handled like a heterosexual couple at all.

Can someone point out to me what would have been different if this was a hetrosexual couple?

Sometimes playing the "gay card" is retarded, and this is one of them.......

Bringing up the "gay" side is supposed to do what?

Should a gay illegal alien invader get any different justice than a hetrosexual illegal alien invader or something?
