During the legal immigration process of my family I also requested four ITINs. Taxes need to be sent in, and if your dependents don't have a Social Security number yet, how else are you going to file? Someone understanding the process is going to be less inclined to thinking something mysterious is going on.

I donít need to be an expert on the ITIN. I have no use for one. However, the IRS clearly indicates an ITIN filer is ineligible to claim the EITC. Those who do, are in fact committing tax fraud, period.

LOL you're the one who keeps saying they did. All I did was read the article (and now I'm slogging through the audit report Individuals Who Are Not Authorized to Work in the United States Were Paid $4.2 Billion in Refundable Credits ) and I can't find any facts to support that statement.

If you get bored try reading it. There is a lot of vagueness and also a lot of statements that just as well apply to legal immigrant and for that matter US citizens who aren't good about paying their fair share of taxes.

And yes I edited the post to provide simple examples of the ITIN.

Unfortunately, due to loopholes, illegals are receiving these numbers. For heavenís sake, how many times have you pro-illegals argued that this is one of the methods used by the IRS and SSA to determine the tax contributions of illegal aliens? Now, due to this exposed fraud, you want to act like illegals arenít being issued these numbers. Incredible!

Oh that would be easy. Non-resident alien is married to US citizen, US citizen requests ITIN for spouse, spouse enters US illegally and starts working. For example. What I do not see is how a filer using an ITIN who is not filing jointly with someone who does have an SS# would be able to claim the credits. The report is very vague on this topic. As a matter of fact this is the only clear statement I could find:

"TIGTA recommended that the IRS work with the Department of the Treasury to seek clarification on whether or not refundable tax credits may be paid to individuals who are not authorized to work in the United States. "

To me that sounds like "we don't really know but somebody needs to find out," which is a far cry from the screaming thread title about $4.2 bil paid out to illegals.

It wasn't EITC, the $4.2 billion was for the claims of Additional Child Tax Credit (ACTC) to ITIN filers...

Did the Washington Post cite the original IRS report saying that?...

I have already told you that the pro-illegals on this forum swear that most illegals are filing taxes using ITINs, and that the IRS and SSA determine their tax contributions according to those returns. I have no proof who has received these fraudulent tax credits, nor do you. So, whatís your issue?

The current version does. It has however been updated so who knows if the original version cited the audit report.
