So, they didnít claim the EITC? Apparently I missed that in the article. Iíll have to re-read. Does the IRS allow non-citizens filing taxes with an ITIN to claim child tax credits, additional or otherwise? Please provide a link.

OK so the proof that $4.2 bil in tax credits was paid out to illegal aliens who were filing using ITINs can be found in posts somewhere on this forum from pro-illegals who made those statements.

I'm not going to bother searching.

No, not the $4.2 billion. Rather, the assertion that most illegals use ITINs to file their taxes, and that the IRS and SSA use those returns to determine their tax contributions. Itís amazing that they are now unwilling to acknowledge it.

i am confused the child care tax credit is based upon your filing of income taxes each year so how can they be using the child care tax credit - its my understanding that the illegals are being paid cash and no taxes are withheld so again how are they getting money back when they havent put any into the system

IBM already said it, It was for the ACTC, not the EITC. It's about 1/4 of the way down.

That probably explains why I am not familiar with those assertions. At any rate the point seems to be that if someone submits a return with an ITIN, the IRS should have the authority to request a determination of the immigration status if something appears suspicious. You'll get no argument about that from me.

Okay, I re-read the article, and saw the ACTC. But, I still donít know if an ITIN filer is eligible for the ACTC, given that they are ineligible for the EITC. I searched the IRS site, but it only indicates the child must be a U.S. citizen. I didnít see anything regarding the status of the filer. Perhaps someone can enlighten us.

Unfortunately, as long as the IRS continues to issue ITINs without requiring proof of legal status, there is absolutely nothing to prevent illegals from receiving them. Yes, this common sense measure is sorely lacking at the IRS.

The ACTC can be lawfully claimed from an ITIN...

Notice it doesn't reflect immigration status, but instead someone with an ITIN is perceived to not be work-authorized for the United States (or they would have a Social Security number). An ITIN being used to file taxes doesn't necessarily mean those with an ITIN are present in the United States (EDIT: or present illegally), or working without authorization. Only two assumptions can be made:

1.) An ITIN means a tax return is being filed

2.) Someone with an ITIN does not have a Social Security number

Yet, the IRS can threaten my mother for taxes my deceased father did not owe. And, pro-illegals continue to think stealing the ID of dead people is a victimless crime. I blame the SSA for advertising SSN info of deceased people online for every scumbag crook to access.
