Perhaps before getting all sarcastic and busting out the eyeroll smiley like you know what you're talking about, you could just ask what he means.

There is a distinction between crimes and civil offenses. When you jaywalk you are committing a civil offense. When you assault someone you are committing a crime. Crossing a border without permission is usually but not always a crime. Overstaying a visa is usually but not always a civil offense.

Crossing illegaly an gettin caught a 2 time IS a felony.

Nitpicky? You're the one getting all eye-rolly when someone points out the facts. It's nitpicking in the same way that my pointing out that, say, someone with multiple speeding tickets is not therefore a prolific criminal is nitpicking.
