....you mean for court proceedings. The same procedure applies in any court case.

Defendants are routinely detained in the case of high flight risks.

Yes, and? Not all immigrants slated for proceedings are high flight risks, you could easily do a case by case analysis here.

We could also easily enforce existing law and deport them.

They haven't been deemed deportable at the point we are referring to - you need court proceedings to occur first.
