It seems that they should give these illegal mother's the choice in quick deportation and allow them to take their children home with them.
Otherwise, yes, the kids need a more stable home with law-abiding parents.
There are more than enough illegals who will choose to simply abandon their children when deported, if this woman actually cares enough about her child to take him home with her then this should not have happened.
It's a shame that her choices put her child in this position.

4-1/2 years after she was arrested she's still in the US? What exactly does she think that she can give that child that the adoptive parents can't? I'm sure when the adoptive parents applied for adoption the father revealed his past mistakes, and in spite of his mistakes the adoption went through.
What the US needs to do is NOT allow these children be put up for adoption until the parent is set to be deported and is given the option to take the child back to their home country with them or relinquish parental rights and leave the child in the US.
I don't get how illegals think that having a child that is a US citizen gives them a free pass if caught. There are consequences to being in the US illegally - to them and as a result, their children. If her children weren't US citizens they would have been deported together. Maybe the word has to get out to illegals that their US children will not keep them in the US nor will it give them a pass against the crime that they committed, which was entering and being in the US illegally.

this is all her fault in the 1st place. if she would not have broken the law and crossed over illegally, then the custody of the child would not be in question.

If she is deported, it's not likely she's going to bother taking either child home with her where she would have to work for a living and work to support them.

Voluntary Departure can be for any immigrant going into removal proceedings. A former contracted detention translator even alluded here on the forum to agents illegally offering monetary enticements to detainees to take VD. Of course he didn't offer specific details when he was queried.

Well a parent who cared about her child would opt for Voluntary departure over years in a detention center separated from her baby. This woman didn't put the child's needs first.
I think she would gladly abandon the child again if she is actually deported. It seems that she's just trying to get him back so she can try to use him to demand her rights to stay.

I was thinking the same thing. I'm sure Carlos' resplacement is in the oven as I type this. The minute she gets out of prison she manages to find a camera and an interpreter to tell her sob story in the hopes of remaining in this country. The fact that she was in prison for over a year with nothing better to do, yet still cannot speak a word of English speaks volumes. It wouldn't surprise me if the boy doesn't speak spanish. How does she expect to communicate with the child? Giving birth does not automatically make you a mother and she definitely seems to be more concerned about her desires rather than the childs needs.
An even bigger question, is why was she not deported after being released from prison?
