It seems the right to keep and bear arms isn’t for everyone.
Despite steady expansion of gun ownership in the U.S. in recent years (in cases such as District of Columbia v. Heller), undocumented immigrants are one group faced with more restrictions. A three-judge panel in Denver federal appeals court upheld a Wyoming federal judge’s decision to impose a prison sentence on an illegal immigrant in possession of firearms, Reuters reported.
According to the court, illegal immigrants can be prohibited from owning guns, as well as non-citizens in the U.S. for legitimate reasons, barring a special waiver, Reuters noted.
The case involved a Mexican native, Emmanuel Huitron-Guizar, who was found in the U.S. with firearms and sentenced to an 18-month prison stay under a federal law that says illegal aliens cannot possess guns, according to JD Journal. The man had come to the U.S. at age three and spent his life in the country, before federal agents found weapons in his home last year.
