Another useful element, and ICE Director John Morton was quite firm about this: One of the "serious" misdemeanors" that will assure rejection is driving under the influence (DUI). Mayorkas added that there will be no secondary eligibility for Deferred Action, the relief offered by this program, and described in an earlier blog by my colleague, Jessica Vaughan. Everyone applying for the program must do so individually, and the eligibility of one family member will not influence the decision-making about other family members. ....Another discouraging item was his reaction to the question about what is done to someone whose application is refused — does that person automatically go into deportation proceedings? "Well, no, it depends" was the answer.

For those cases that are deferred U.S. Citizenship and Immigration Services can decide to give work permits (or not), if you can prove that a work permit is an economic necessity.
There is no guarantee of work permits. There isn’t even a process given for work permit applications. This is not an executive order and this was confirmed by Cecilia Muñoz, director of the White House Domestic Policy Council, who probably had her most honest moment since becoming part of the Obama administration when she appeared on Univision’s Al Punto with Jorge Ramos yesterday morning. This is not administrative relief. This is not legalization. It is not even a cancelation of pending deportations. At best it is an abeyance, at worse it is another memo on top of the previous memos, like the Morton Memo, which have not been applied (see my previous posts here and here).
And indeed the memo is just vague enough to allow for many to not have their cases deferred.

It is the principle of the thing. Obama should never have done this especially since so many Americans are out of work even though he can't pull it off. It was a political move for votes by Obama to sucker in Hispanics once again. From what I have read they have fallen for it hook, line and sinker.

Probably for the same reason many Progressives thought that what Obama did was give them some sort of relief that he couldn't do. The Progressives were tickled pink with his speech thinking they were given, opportunity, relief, amnesty, etc. IMO
Well the radio shows geared to illegals are telling them that they can have a couple DUIs and it won't count against them. And shoplifting would be okay but armed robbery would not be okay.

Since Obama has promised 800,000 illegals their amnesty and work permits - if he begins to deport all the others, I would be extremely in support of that.
Now the illegals have nothing to whine about, they have their amnesty, their Dream Act, 800,000 new work visas. The rest must go.
Immigrant rights advocates barely had time to digest the Obama administration's announcement last week that it would stop deporting some young immigrants () when the questions started flowing in: Am I the right age? Does an arrest disqualify me? Do my parents qualify?

There is so much mis-information out there, there is no wonder why people are in an uproar on both sides. This policy is a "should do" not a "shall do", it is up to the OIC of the field office whether to pursue deportation or not. This isn't if you get caught by an CIE agent you automatically get released as was implied. Nothing is supposed to "stop immediately" as discretion must be applied for.

I can't imagine how Obama can get this up and running in time for the election. Government beauracracy is very slow. He may have shot himself in the foot again and made these people mad. Well it's interesting -- one of the first questions these newly amnestied had was if they can no go visit Mexico, can the work visa be used to get a passport or cross back into the USA easily and legally. Apparently they are homesick, miss relatives back home, miss their friends.
After all their crying and whining that they were too scared of their homeland, didn't know anyone, would never remember their Spanish, so it would be unfair to deport them, it's hilarious that many apparently were hoping that this amnesty would let them go home.
The immigration lawyers are telling them to be careful -- no one is sure exactly how long a criminal record they can have and that if they show up to apply and don't qualify, then it's possible they could be deported instead.
And what happens to those don't find a legal job within a certain period of time? Is it going to be okay to just be hanging out here, or working for cash under the table if they have legal work visas? And will they now be expected to pay into Obamacare? And income and social security taxes?

This is madness. All illegals should be deported. Breaking our immigration laws should permanently disqualify you from EVER gaining American citizenship unless you do something truly extrodinary.
