In brief, the APA requires agencies to publish in the Federal Register any proposed rules, regulations, procedures, or other initiatives that have a public impact. The APA requires the publication to occur well in advance of the proposed implementation date to allow all interested parties ample time to comment on the proposed rules. It is an important exercise in participative democracy, and most agencies (and administrations) take it seriously. Apparently not here, not now.
As was widely reported in many television and print media outlets, the program started taking applications from illegal aliens on August 15 — note the date. Yet, it wasn't until a day later, August 16, that a Federal Register notice appeared soliciting public comments on this deferred action initiative. And the notice is a masterpiece of fuzzy obfuscation:
DHS has justified this post-facto publication in the Federal Register of what it has already put into action by citing the emergency provisions of the APA. But what, exactly, is the "emergency"? It's not like the aliens were not already physically present — at least they're supposed to have been if they are really eligible, but that's another whole story, isn't it (wink-wink, nod-nod)? And it's not like there is any catastrophic moment moving toward us that requires prompt action. The program may in fact be a catastrophe in the making, but I don't think that's what the legislators who enacted the APA had in mind when they established emergency promulgation provisions under the law.
The Administrative Procedure Act (APA) governs the process by which federal agencies develop and issue regulations. It includes requirements for publishing notices of proposed and final rulemaking in the Federal Register, and provides opportunities for the public to comment on notices of proposed rulemaking. The APA requires most rules to have a 30-day delayed effective date. In addition to setting forth rulemaking procedures, the APA addresses other agency actions such as issuance of policy statements, licenses, and permits. It also provides standards for judicial review if a person has been adversely affected or aggrieved by an agency action.
This couldn't possibly be the "transparency" Obama promised. Why would they not, as usual, publish DACA for public review prior to its implementation? And, exactly what was the "emergency" warranting such an unusual action? What other laws did they bend for this amnesty?

I am a Republican and I can't help but wonder why my party has been so silent on this. Why hasn't Romney brought these very points up as an attack on Obama during these pre-election months? Will he bring it up during the debates? I certainly hope so.

I can only surmise, because Obama and other pro-illegals have effectively silenced opposition through their race card campaign. They have made illegal immigration a "civil rights" issue, and portray all opponents as racists and bigots, the likes not seen since the ugly days of Jim Crow. I imagine the Republicans are afraid if they oppose, they'll be labeled racists. No doubt, the liberal MSM would have a field day with character assassination. It's beyond belief.

I don't understand what he meant by that and he didn't elaborate. It could mean something worse than what Obama has implemented. To tell you the truth I am very worried but I will still vote for him hoping what he meant is that his solution will be better for the American people. I hope his solution will be explained during the debates.

He was pandering for votes, just like Obama. Most of the politicians are so spineless they won't dare say anything to upset Hispanics who overwhelmingly support Dreamies. It's pathetic.
