An expert on police chases said the decision to fire on the truck was "a reckless act" that served "no legitimate law enforcement purpose."

"In 25 years following police pursuits, I hadn't seen a situation where an officer shot a speeding vehicle from a helicopter," said Geoffrey Alpert, professor of criminology at the University of South Carolina. Such action would be reasonable only if "you know for sure the person driving the car deserves to die and that there are no other occupants."

Maybe they were throwing rocks at the helicopter...

Note this is a Texas State Trooper and not a US Border Patrol Agent.

The tires were shot out, the driver lost control and 2 occupants died. DPS policy's general manual, which says troopers are allowed to use such force when defending themselves or someone else from serious harm or death. Shooting at vehicles is justified to disable a vehicle or when deadly force is deemed necessary. The tires were shot out and 2 of the 8 occupants were hit. Kinda hard to know they were under a tarp in the bed of the truck.
They were covered with a tarp, but as the car sped away from the game warden and the helicopter, the men "were having lots of trouble holding on to that tarp, Caceres said. "They must have seen them."

So whats the point of creating this topic? So far it seems as though the DPS officer was within his policy. It is a shame 2 people died due to the ignorance of the driver. The sharpshooter appears to be justified from DPS policy.

Note that (in sometimes strange form around here) it is titled correctly that it was a Trooper...

I would hope the the Border Patrol would not have a job position for a "sharpshooter"...

Because there seems to be a belief around here that whenever illegal aliens (these were Guatemalans) or Mexicans are shot, it is an incident where they were "throwing rocks"...

Most of the topics involve BP shootings, not DPS shootings. The drivers ignorance is what killed the 2 occupants. Ignorance on behalf of illegals kills the overall majority of them, whether they throw rocks or not.

This was an entirely different incident with different circumstances. We only mention rock throwing when there is a clear indication that it was. As LR said the trooper was well within his bounderies to do what he did even though this wasn't a rock throwing incident.

It is regrettable that lives were lost, however the root cause remains the same. People opted to violate our laws by entering illegally. They further compounded the crime by refusing to yield to the police. No where is it written that crime is a safe path to making a living. Had the illegals obeyed our laws all of them would more than likely still be alive today.
Given the amount of drugs smuggled across the border it was a reasonable assumption that this vehicle was being used to smuggle drugs.

No, it is parroted here when the Border Patrol has said it was "rock-throwing", even when video or other evidence show it was not...

Have you seen the physical layout of the scene where 16 year-old Jose Antonio Elena Rodriguez was shot (a total of seven times, including two to his head) in Nogales, Mexico?:

Quote:
At the main border crossing in Nogales, the fence is at street level. Moving west, toward Contreras Sanchez's office, three blocks away, the fence climbs a steep hill on the U.S. side. Where Elena Rodriguez was shot, the base of the fence is 25 feet above street level; the top of the fence is roughly 45 feet above where the boy was shot.

The angle is such that it would be all but impossible for a rock-thrower to hit someone near the fence on the U.S. side.

It's even thought that the muzzle of the weapon (the Border Patrol has declined to say what it was, although the number of times Jose Antonio Elena Rodríguez was hit points more to an M-4 carbine than a pistol) would have had to have been in Mexico, through the fence, and the shooting would be on unreleased video taken by surveillance cameras on the U.S. side...

Well as I have said before it is just one big giant conspiracy by our Border Patrol to kill as many Mexicans or other Latinos as they can get away with (motive unknown). We are ever so grateful that we have you to call them out on their lies and unlawful behavior.

Sounds like probable cause to me. I put the blame straight on the driver of that pickup for NOT stopping AND trying to make a run for it.

No, the following quote offers a good explanation. Had the driver stopped as ordered, like most with nothing to hide, no one would have been killed. If illegals were being indiscriminately killed, we would have few illegal aliens. In fact, we wouldn't have an illegal immigration problem, because, they would be too afraid to even enter this country.

I'm not sure why you're trying to twist this into something it clearly is not. And, a professor of criminology is hardly an "expert" on police chases.
