As an individual, yes. This case, however, is about Congressional procedure, not an individual. Without fully presenting the available information, we are left to accept their interpretation of the memo.

Many illegals actually have stolen social security numbers and the Obama administration has proclaimed it isn't a crime for them to to use stolen identification or commit felony document fraud.

Many illegals have "legit" SS numbers as well. Anyone that comes here on a long term visa is entitled to obtain a SS number and a work permit. The SS administration does not link up with immigration when the visa or work permit expires. The SS number remains valid. Also illegals that apply for asylum or "withdrawal of removal" are also are permitted to apply for SS and a work permit while their cases are pending.

A "non-immigrant" can file an I-765 for work authorization, but it's often a long shot even for a very legitimate visa category...

Since most illegal immigrants just jump our borders I would guess that most of them don't have a legitimate SS number but using a fake or stolen one instead.

Most international students have SS numbers and are permitted to work. International students make up the large majority of visa over-stayers. And like I said before if an undocumented alien files a petition with the court such as asylum or withdrawal of removal they are also permitted to work while their case is pending.

I'm having issues with your phrasing of that one particular sentence:

Immigrant Visas are "long term", but already work-authorized (without issuing an EAD card). Other "non-immigrant" categories are required to file an I-765 for work authorization. Although the process is much more streamlined and paralleled in the last few years, it has the same requirements as before.
