Someone with an ITIN can still be an illegal immigrant.
Thank you! Mea Culpa. I did some looking today and found the same. Now I'm not sure how I feel about the issue posted by the OP. It seems to me that professionals would more than likely not be illegal, but I understand the concern now.

Illegals are definitely usually undereducated/underskilled, but that doesn't mean they all are. People of both genders, all religions, all nationalities, all education levels, gay, straight, bi, what have you...they're all capable of being illegal immigrants. It's not something you are, it's something you do, just like any other criminal act.

Oh, I understand that BigDGeek. I guess I was baffled by my SO being contacted by people to purchase houses. He's bilingual so he gets tons of Hispanic people calling him, and his first questions to them are whether they have prequalified and if they have papers. No papers, he explains to them that they basically don't exist and he can't help them with either buying or renting. The people he has worked with that had ITENs were in the process of becoming citizens. It's much more complicated than I ever imagined.

It is. There's no rule that says illegals must be poor, unskilled, or uneducated either. And I wouldn't assume someone with an ITIN is documented. Also bear in mind that the overwhelming majority of the time, someone will have been issued an SSN if they are here on a permanent immigrant visa. Green card holders have SSNs, for example. AFAIK, H1Bs also get an SSN but their dependents (spouses and children) get ITINs.

And ITINs can be issued to those that aren't currently in the United States, although if someone will eventually be eligible for a Social Security number, they will have a hard time getting an ITIN from the IRS...
