Most are criminals, as coming in to the country illegally (or "without documentation" if you prefer) is a crime in and of itself and many of the ones who overstayed on a visa are committing a plethora of assorted other crimes.
While we're at it ... let's round-up all those Cuban's who came here illegally, as well. Let's tag 'em all, and ship them back to Fidel.
Did you read any of the rest of the article? The entire point of the bill is to allow illegals to work as health care professionals. Some illegals do have ITINs as others have so eloquently pointed out.

Because legal status is NOT checked when giving out ITINs. So there are illegal aliens who possess ITINs even though they have no business being here.

OK. Please explain how. I'm here to learn. I'm not being sarcastic. How do they obtain the ITINS? I'm trying to understand. The way that it was explained to me was these are people who are either here working legally without any intention of staying and becoming citizens, or people who are in the process of becoming citizens. I've been under the impression that illegal aliens are those who are working here illegally. Like I mentioned, when my SO gets a call from someone wanting to buy a house and they tell him they don't have papers, he tells them that he cannot work with them. When they have ITINs, which has only happened a couple of times, he has been able to work with them. I'm baffled because I see ITINs as documented, if not citizens. Does that make sense?
To me, when illegals get ITINs, they are "ill gotten", meaning that they were never meant to be given to illegals. ITINs were created for people here on guest worker visas so that they had a way to pay US taxes.

They apply for them. The IRS does not verify documented status. That is not its job, and it has gone on record saying as much.
Someone with an ITIN can still be an illegal immigrant.
