Default Yet another victim of Johnny Sutton

Below is a letter that former Border Patrol agent Noe Aleman wrote to SOS. Unfortunately his story has not been printed far and wide. Noe is also a victim of Johnny Sutton. He has already served his time in prison. If you would like to write Noe or support him, here is his address: P.O.Box 13332, El Paso, TX 79912

Please forward Noe's story and contact your reps!! Let our congress know that Ramos & Compean are not the only victims of Johnny Sutton and corruption!!

Please, please distribute his story far and wide. There is a pattern with Sutton and his team.

On behalf of my wife Isabel and our daughters, I want to thank those who have maintained their support of us at Save our State. We have been quite overwhelmed by our own government's persecution of our family. The cost to my family is something no one could ever imagine possible living here in the United States.

Our family contacted Congressman Reyes, for his assistance when our persecution began at the hands of the Department of Justice. Unlike Agents Compean and Ramos, he did meet with us and promised to help our family. However after meeting with him (and his staff) several times, Rep. Reyes finally informed us that there was nothing he could do.

The Department of Justice and Johnny Sutton prosecuted me, and violated every aspect of not only our civil rights, but also basic human rights for nothing more than an error on their part on immigration documents which could have been handled with very little effort but chose instead to prosecute me and my family.

My wife Isabel and I adopted as our daughters, my wife's nieces in the Texas State District Court located in El Paso,Tx. On April 23, 2004 The State of Texas granted my wife and I unconditional adoption. Our daughters were enrolled in school and were doing very well. At no time could we ever have imagined what would soon take place.

My wife Isabel asked me to look at our I-94 visa to see when the standard 90-day visa would expire so we could renew it. Our daughters entered the U.S legally. I was surprise to note that the document had provided one sole business day for their permission to enter the United States on legal business. (It has been investigated that the standard practice when issuing entry visas at the ports of entry is 90 days.)

I reported what I thought was an error at the Citizenship and Immigration Services office in El Paso Texas. (CIS) I was advised by an immigration attorney while at the CIS office to ask for an adjudication officer and seek an extension of the "parole" as it is known. I did exactly as I was advised, which I was informed by the immigration attorney, who guaranteed me that it would not be a problem having already gone through the adoption process with the Texas State District Court in El Paso.

After a number of contacts with the CIS office, I was advised that our visas had been approved and to come and pick them up and to bring our daughters which we did. I was then arrested and charged with harboring illegal aliens. My case was tried in the same federal courtroom, by the same participants as Agents Ramos and Compean.

The Department of Justice never presented the facts in our cases, they just made things up as they went along, as they have done with Agents Compean, Ramos, Brugman, Sipe, Rhodes, Deputy Sheriff Hernandez.

Here is just a sampling of what Sutton's prosecutors did to my family and how our civil rights were violated:

I was charged with Smuggling/Harboring my own legally adopted daughters Yet, the government has never opposed the adoption as finalized and recognized by the State of Texas, which remains valid today. (This was the same type of false statement that Sutton has done to Agents Compean and Ramos though they claim that Agents Compean and Ramos are the wrongdoers and filed false statements.)

Next, the government through agents from the Office of Inspector General and the FBI interrogated our daughters without counsel present and were trying to get the girls to admit they were being abused, which they vehemently denied. This is a violation of the civil rights of our daughters for being questioned without counsel present to protect their rights. When I think of what the government did to protect the non-existent rights of career drug smuggler Osbaldo Aldrete-Davila as compared to the civil rights of our young daughters, it makes my wife and I upset every time knowing what happened to our daughters.

After no evidence of abuse was discovered from this hostile and illegal interrogation, in which the girls were traumatized psychologically; our daughters were, in retaliation for not lying to the government, placed in Removal Proceedings late June 2004.

At the Immigration Hearing on June 20, 2005, our daughters, through their counsel, applied for Admission to the U.S. based on the fact that they are legally adopted daughters of U.S. Citizen Parents. Interestingly enough the Immigration Judge was a prior U.S. Attorney, he had been with the U.S. Attorneys for several years. He knew me as a prior Border Patrol Agent. He had only been an Immigration Judge for one month. Our Attorneys asked him to recuse himself from the case as he had worked with the U.S. Attorneys Office and knew about my case. He refused. The Immigration Judge denied the Application and ordered them removed.

Upon ordering our daughters removed two immigration officers were instructed to remove our daughters from the hearing. I tried hard to hold on to my daughters as they were pulled from me, as they were taken away I could here my daughters yelling and screaming for me to help. My wife and I were escorted out of the federal building by several officers and told to leave
the premises.

We appealed the decision to the Board of Immigration Appeals ("BIA"), who upheld the original ruling.

Our daughters were taken to an immigration camp for children who are in the U.S. without any parents or guardians. We were denied all visitation, and communication by the Department of Justice throughout this process, though, again, the girls are our legally adopted daughters. Our daughters were held there for over a year and subsequently deported to Mexico though their legal and only family remains here in the US. Again our daughters were still minors when they were deported to Mexico. They are forbidden to enter
the U.S. for 10 years.

I was informed that according to Assistant U.S. Attorney Debra Kanof that our grand jury hearing transcripts would never see the light of day, exactly what would have happened to my fellow agents Compean and Ramos' transcripts without the help of Congress.

Finally, Johnny Sutton's assistants exercised excessive and abusive interrogations and during testimony before the grand jury our daughters were addressed as "little whores" by the Assistant US Attorney who conducted the hearing on behalf of the Government.

What kind of disgusting place has America (politics) become to engage in such tactics against its own citizens and children. While this case has nothing to do with my job, it defines the hypocrisy of the so-called Department of JUSTICE who protects dopers, and not agents who do their job, families, or it's children.

While betraying and preying on young children and violating their civil and human rights. Again on behalf of my family I would like to thank everyone for all their help.

God Bless You,
Noe Aleman Jr

Yep, another person got busted for breaking the law, but because he's a border agent, everyone's supposed to just believe his 'story'......

Funny, his story doesn't track with the trial testimony.

Just like those other 'heroes', Ramos and Compean, they lied at trial, they tried to cover up their crimes, and they were found guilty by a jury in a court of law.

Sutton didn't even prosecute Ramos and Compean, so to try to compare the two is not representing the reality.

Not to mention, Sutton didn't prosecute Noe, either, his case was investigated by the Department of Homeland Security, Office of Inspector General, and the Office of Internal Audit together with the Federal Bureau of Investigation.

Assistant United States Attorneys J. Brandy Gardes and Stephen Garcia prosecuted this case on behalf of the government.

Noe's case was already appealed and the appeals court didn't find any problem with what the jury found, he broke the law, tried to cover it up, lied about in court.

The decision by the U.S. Court of Appeals for the Fifth Circuit upholding Aleman’s conviction cites evidence that Aleman lied about turning in forms and that he and his wife lied about the girls living in their home and that he lied to border officials about the girls location in Mexico.

The case was tried nearly three years ago.

These cases were tried in a court of law, and in Noe's case, they were even retried by the appeals court. The jury handed down the verdict, they were convinced by the evidence in court.

The prosecutor did what prosecutors are supposed to do, build a case when the evidence shows illegal and criminal behavior, and take it to court to be decided.

This idea that it should be decided by SOS on their website, or that people ought to send money is bunk.

so what you are saying is.. that ANYONE that has broken the law SHOULD be lawfully processed. Then why is the thousands of illegals from south of the border, who in FACT are breaking the law, a FELONY, and who are in FACT criminals, not being lawfully processed. It seems that you only consider those who you do not like or agree with should be lawfully processed.. on the other hand, those who you rally for, and like, who are in FACT commiting a FELONY, you seem to think it's ok for them to commit a FELONY. You can't have it both ways.. ILLEGAL=FELONY ... PERIOD!

Why prosecute those sweet, good-natured, hard-working illegal aliens when you can pick on a perfectly innocent American citizen?

At least, that's U2's take on things.

Illegal alien=complete immunity from prosecution, even if you run down a three year old American child while in a drunken stupor.

American citizen=death penalty for jaywalking.

Can't you people get with the program?

Right? I think U2 is just a sheep if he thinks anyone from Suttons offices or anything that has anything to do with Sutton is really straight up law. Sutton is corrupt.

AB its not a Felony its a misdemeanor. That was one of the catalysts that got the marches going in our streets. The Republicans put in the bill they were trying to pass to make it a Felony. The Republicans tried to change the bill but the Democrats blocked the change. The Democrats didn't want it changed to make the Republicans look bad yet they vote for amnesty for everything. They a slippery people.

You're welcome! I will say, it was good because if that helped cause the marches, it woke America up to how big this problem is. They were their own worst enemy. Yet, you read the posts about Hillary winning and I tell you, these people don't get it. They are locked into a party not the nation.

Trolls thrive on posting all sorts of outrageous statements and watching people's response to them. After all, it is the middle of January and they have already done all the crossword puzzles and read all the books they have under the bridge. So what better way to pass the time than go online and annoy people?
(the ignore button is very helpful if you find them bothersome)
