Tell ICE that someone is "probably" an illegal alien? And what would they base that on, brown skin and an accent? That is not how it works. Jails do not require people to prove their citizenship when they are arrested, and in fact many citizens who are arrested would have trouble proving that they are in the US legally because a large number of them don't even have a photo ID.

When a person is booked they are fingerprinted. Their fingerprints are electronically transmitted to the State Dept. of Justice which transmits them to the FBI. They are automatically checked for holds/warrants either by local, state, or federal jurisdictions. If there is a match, the jail contacts the agency that issued the warrant for confirmation that the hold is still valid. The FBI also shares the fingerprints with DHS of which ICE is part of. ICE runs the fingerprints through their database to see if the person is subject to investigation for deportation. In many cases ICE also requests a database of names so that they can do a name match rather than one based on fingerprints. Obviously detaining someone names Maria Olivares without fingerprint verification is subject to error and has resulted in citizens being illegally detained.

The system falls apart and subjects the local agency to sanctions by the courts when ICE places a hold and then never picks the person up or inadvertently places a hold on a citizen. ICE needs to follow the same protocol that the FBI does for a wanted person - have a judge sign a warrant which clears them and the local jail from any claim of wrongdoing for keeping the person in custody. You would have to ask ICE why they can't clean up their act and make their process of detaining people more bulletproof rather than running around blaming jails for not complying with their demands.

I think we will see ICE become much more efficient in picking up illegal aliens held by local law enforcement and get these illegal aliens back "home".

Based on what? It's not like they are new to this, they've been doing this for decades and haven't gotten their act together yet.
