“We have complied with zero federal detainer requests this year,’’ Police Commissioner James O’Neill said during a City Council budget hearing.

“We strongly feel that it is not the role of a municipal police force to enforce federal immigration laws

NYPD refusing to comply with feds’ detainer requests on illegal immigrants | New York Post

Then YOU need to be arrested by the feds and charged with harboring illegal aliens, Mr O'Neill.

Well, they may have a point. Federal officials are really supposed to enforce federal law. There have been SCOTUS cases determining whether federal officials can make state or local officials enforce laws or otherwise comply with their orders, and sometimes the state or lower levels win. If the feds want people in NYC to detain illegal immigrants, they should get some of their own people on that. Truthfully, the NYPD has a lot more to worry about.

LOL, you righties funny, if the person arrested is sentenced then the Feds know where to get them when their sentence is complete, as for not being an arm of ICE, they do not consider it to be their job so while do it.

Always amusing to listen to one side scream State Rights, up until the second some State does something they disagree with then they show they really love the Feds and want them to force a State into submission, do as we say or you will be punished. Hypocrisy Abounds.

That sword does cut both ways.
Some cheer when a state opts to ignore Federal law in favor of creating a sanctuary state for illegals. Yet those same folks flip if a state tries to enforce immigration laws. The argument can be made that in both scenarios the state is pushing the envelope of legality. That said I always prefer to hold criminals accountable. Let's face it. Very few illegals are guilty of only being here illegally. Most are also guilty of breaking a host of other laws as well. That inconvenient truth the pro-illegal side likes to avoid.

I really have no opinion on this particular issue, just sharing some facts. It could be an issue.

It's all a bit confusing to me.

Are states not supposed to assist in any federal law? ATF or DEA issues? FDA or Postal Inspector investigations? Work by the EPA?

If that's true, let's shut it all down.

Considering how much of his department's budget comes from the federal treasury, I don't think it's overly strenuous work to continue detaining someone who's already detained until ICE can pick them up.

They should hold them for whatever crime they did locally, and then tell ICE that they have until 5 pm (or whichever time) to come pick them up or they will be released. That wouldn't cost them anything extra.
