Look at your own words. If you are breaking a law to be in a country, you are by definition a criminal. If you are stealing someones identity, you are by definition a criminal.

I can also tell you from the point of view of law enforcement, they have all kinds of problems with illegals because they don't have documentation about who they are. They can commit a crime here and run back across the boarder then return later with a different identity.
