Silvestre Delgadillo, 28, remained on the run and authorities had "no idea" whether he fled to Mexico, Treviño said.


Delgadillo, who was convicted in 2005 on a felony drug charge, has been charged with unlawful possession of a firearm by a felon, a third-degree felony.


But the actual homicide is complicated by Texas' castle law, which allows people to use lethal force to defend themselves and their property.
Delgadillo is accused of shooting Roberto Garcia, 17, late Friday night.
"He is there to protect his residence - protect the business - under the direction of the owner," Treviño said.

This is clearly not your "good character" illegal alien. As a convicted felon, he should not have even been in possession of a gun. Furthermore, he had already been deported.

Sadly, they will probably never apprehend him. He is probably already out of the country, and will simply bide his time, only to reenter the country illegally to continue his criminal lifestyle.

Given his prior criminal record, no 'reputable' company would have hired him in this capacity.

Good character or not under Texas law he has a right to protect himself and where he lives. In this case he happened to live in the store. Believe it or not, this applies to anyone legal or not. So technically he violated no law by shooting to defend himself and defend his place of residence. This is a Texas law. He can be convicted or re-entering the country illegally.

Just the very insanity of the phrase "illegal alien in good character" is an oxymoron to say the least. But then illegals and their huggers operate under an exclusively deranged system of picking and choosing the definition of morals, character and justice don't they?

Speaking of morals, character and the lack thereof:

Good point. No excuses for her actions... But the grand jury will have to decide if she knew he was a felon before providing him the gun. You know how these things go. Money, good lawyer, she walks.

Also, under 18 USC 922, it is a federal offense for a convicted felon to be in possession of a firearm. It's a moot point anyway; he'll never be charged, because they'll never apprehend him.
