He came to California from Afghanistan at age 12, a refugee of the Soviet-Afghan war and, he says, a victim of torture.

His family settled in Fremont, where he went to school, got a job, became thoroughly Americanized - and made one bad mistake. In 1997, when he was 22, he had sex with his 14-year-old girlfriend and served eight months in county jail.

But by 2003, he had put his life back together and opened up his own body shop. Believing his past was behind him, he applied for U.S. citizenship. He's been in a federal prison in Arizona ever since.

For more than four years, Obaidullah "Chito" Rahimi, 33, has languished behind bars, ordered deported because of that old conviction. He faces an agonizing choice:

Should he remain in an American prison and fight his case in court, in hopes that someday a judge will let him go home to his family and friends?

It is a sad and unfortunate situation. But since illegal immigrants have gotten way out of control, I have to go with deportation, in all cases. It's too big of an issue to have gray areas right now.

As you stated.

Where Chito screwed up was having sex with a 14 YO girl when he was age 22------he had been here for 10 years and should have known better.

Otherwise; he being a political refugee I would have supported his case for asylum.

Pedophiles are never cured. This guy has a thing for very young girls, he's raped before and he would rape again. Ignorance of the child rape laws is absolutely no excuse to rape a child.

That's the problem when other cultures move here, what's ok in their country is not ok here. 22 year old having a 14 year old girlfriend? Over my dead body!

An excellent argument for what is permissible in 3rd world countries and cultures. Another reason why we should limit the number of legal immigrants from these countries. Culturally embedded traditions rarely if ever die.

Thats a compelling reason to execute sex offenders regardless of legal status

This is true. IMO, all pedophiles should be castrated prior to being released from prison. Actually, Id take it a step further.

For child rapists (below puberty if the perp is above a certain age) I tend to agree with that punishment.

Now, if an 18 YO girl was 'doin' it' with her 17 YO boyfriend------that should not even be a crime. Many states have 'Romeo and Juliet' laws (if the adult is less than a certain number of years older than the juvenile) that preclude any sort of legal action.

Besides: a 14 YO can be charged as an adult for certain crimes.

Translation: if a kid does something stupid; he/she becomes an adult yet said kid's twin sibling remains a child despite being, class valedictorian?

Tough calls any way around.
