A former day laborer was sentenced today to 15 years in prison for kicking a fellow worker to death during a drunken fight in Montville, and the killer’s nephew was sentenced to five years for helping dispose of the body.

“This was tragic, unnecessary and most likely the result of alcohol and drug abuse,” said Superior Court Judge Thomas V. Manahan in Morristown, adding those factors were not excuses for the slaying.

Marcos Jose Riveria, 24, admitted in August that after victim Alfredo De Los Santos Francisco was dead in December 2005, he helped hoist the body onto his uncle’s back so it could be carried to a wooded area of an industrial park in Pine Brook. He was sentenced today to five years in state prison.

The uncle, Mario Nieto-Rivera, 35, had pleaded guilty in August to aggravated manslaughter. He said that he and the victim started arguing after drinking heavily together in an abandoned house on Chapin Road in Montville, and that he kicked Francisco in the head after the victim attacked him first. The judge sentenced him to 15 years in prison, saying he had to serve 85 percent of the term before parole consideration.

Both men are likely to be deported upon their releases to their native Mexico as they are in the United States illegally.

Authorities said that Francisco, 36, died of blunt force trauma to the head and suffered multiple other injuries including a fractured cheekbone by his eye socket, a broken jaw and nose.
