Because the purpose of the Fourteenth Amendments first section was to end the denial of those fundamental rights that belong to all citizens by virtue of their citizenship under Article IV, Sec. II of the U.S. Constitution, it was imperative to first define citizenship of the United States. Otherwise, a State could refuse to recognize newly emancipated slaves as citizens by withholding the right to sue, make contracts, due process, purchase property, etc. Therefore, the Fourteenth Amendment acts to recognize all persons born to citizens of the United States as citizens.

This is an interesting revelation because it is a common belief today that the court had never adjudicated the meaning of "subject to the jurisdiction." Wong Kim Ark says the court had and that it was correct. Bad news for illegal's and their anchor babies.

Long but excellent explanation clarifying the deliberate abuse of the 14th Amendment.

Per a Supreme Court ruling:

Quote:
The Court essentially stated that the status of the parents determines the citizenship of the child. To qualify children for birthright citizenship, based on the 14th Amendment, parents must owe "direct and immediate allegiance" to the U.S. and be "completely subject" to its jurisdiction. In other words, they must be United States citizens.

The 14th Amendment to the United States Constitution
- Another good site that lays it out in fairly plain language. The deliberate abuse has got to stop.

But will our newly formed socialist gov do the right thing? Given their desire to step all over our 2nd and 4th amend. rights I have my doubts.

Agreed. I think I'll email the article to several of "our" members of congress.

More Americans need to join the fight and hold their respective congress persons' feet to the fire. Until that happens they will continue to remain in office while living in a perpetual state of oblivion.

Clearly, illegal aliens are NOT citizens of the United States. Therefore, their children should NOT be recognized as citizens. The deliberate misinterpretation of the 14th Amendment is beyond unconscionable.

Agreed and we've been saying it from the start. The fact that our government has continued to ignore the reality is nothing more than part of their deliberate, treasonous scheme.

I think that it would be "uniquely" interesting to hear Obama's views on the 14th amendment and what "subject to the jurisdiction" means to him.
