Should illegal immigration be a crime for a first offense?

Right now illegal immigration without prior deportations is a civil offense and they can, of course, be deported but it, by itself, cannot result in a prison term.

If they have previously been deported and re-enter, they are subject to a prison term of up to 2 years (generally).

What, in your opinion, should the penalty be for illegal immigration on the first and subsequent offenses?

no, on the first offense, you just process them, get as much biometric info, warn them about the consequences of re-entry and deport them. and also tell them that upon a second catch (and after serving their time), they will be chipped and then deported. get it all in writing. with a consular attorney present.

jail time would be too severe for someone whos only crime was being on the wrong side of the border.

there can be exceptions for people who are violent criminals. they get punished for their crime (DUI, Rape) with an additional enhancement of being illegal. kind of like a hate crimes enhancement.

but if they were aprehended for riding their bike without a helmet and were found to be illegal, then a simple warning and deportation process would suffice.

Since the present system is obviously not working, I suggest the "shame" system. No jail time, no deportation....only the message that "Illegally entering the United States is against the law....and you already know that. It is not fair to those who LEGALLY enter, it's not fair to the local American workforce, and it brings discredit upon the entire immigrant community....and you know THAT, too. It's an unfair, sneaky, underhanded, rotten thing to do, and everyone KNOWS it's illegal, and anyone who DOES it ought to be ASHAMED of himself !! And any COUNTRY that knowingly pushes its own people to illegally enter another country, and then has the unmitigated audacity to WHINE about it, should be ashamed of ITSSELF, as a COUNTRY!! What kind of a "country" would do that, ANYWAY???"..

I don't know if that would work...but it's probably worth a try. The guilty parties would know who they are....And it couldn't possibly be any less effective than the PRESENT system.

My next project will be to try to 'embarrass' serial killers. Maybe their consciences will stop them, since the 'cops' can't.

They should never be imprisoned here. That is just a waste of more tax payers money. They should be deported, period. I would suggest a tracking chip but that's a little invasive and I wouldn't want to violate another human being. But unless a crime other than "skipping the border" is committed, they should be sent home post haste. Perhaps a deal could be worked out with Mexico to lock up their "runners" for a while once they are returned home. But I am sure they wouldn't go for that, they depend on American cash to keep that place going.

I voted 'yes' but till at least our southern border is fortified; if a non US citizen/green card holder is caught within a mile or so from the demarcation line..........simply ship him/her back home and call it good.

For the illegal, regardless of crime, one warning,before it becomes a felony with jail time to be served at the " Sheriff Joe detention Center" In Arizona.

For the employer.....$15,000 fine for each illegal employed for the first offense and loss of business license for the second offense.

Their first offense was sneaking over here in the first place. I don't feel sorry for any of them, we have Americans living in poverty that should be taken care of first. Jail time here would be a free roof over their heads and free food, and then they use their kids to get sympathy. Jails should be built down at the borders with our military helping the border guards. That's as far inside America as they would get. There's a war going on down there between the drug runners and gangs and our guys are not getting any help. Illegals need to know they are not welcome here unless they come in through the front door. That doorway would not be very wide.

and based upon the immigrants ability to survive here with no government( Taxpayer) assistance programs available, the skills required to actually add something to this country other than a willingness to work for slave wages.......

And put them all in pink underwear and in tent cities. No need to build special detention centers down near the border... house them in tents in the middle of the desert (in Maricopa County so they "belong" to Sheriff Joe). And, feed them green bologna - if that's what the inmates are having today.
