The lawsuit filed by 37-year-old Luis Jimenez's cousin and legal guardian sought nearly $1 million to cover the estimated lifetime costs of Jimenez's care in Guatemala. It also asked for damages from the hospital for "unlawfully detaining" him and punitive damages to discourage other medical centers from taking similar action.
Unadulterated BS! So now a U.S. hospital is responsible for the financial support of an illegal alien for the duration of his life in his country of origin?
Personally, the most infuriating aspect of this issue is the fact that there are numerous accounts of indigent U.S. citizens being given cab fare and simply discharged from hospitals, and left to fend for themselves. At least they treated him and repatriated him in a compassionate manner. Had he been a citizen, the hospital may have simply dumped him on the street. But heaven forbid, an illegal alien receive the same sorry treatment as a U.S. citizen.
U.S. hospitals should only stabilize illegal alien patients, and ICE should immediately deport them and let their countries provide intensive medical care. Obviously, illegal aliens and their relatives have no appreciation for the medical treatment they receive in this country, given that this isn’t the first hospital to provide millions of dollars in unpaid medical treatment only to find themselves as defendants in a lawsuit.

yes i agree. dumping patients is awful. it was very common here (LA). not till recently (past several years) did they crack down on it.
this suit was garbage from the begining. the hospital should have just countersued for costs incurred in the caring of this individual.
that would have settled the charges real quick.

What a galling family. They expect to pay nothing at all, and it makes total sense for this man to receive maintenance care in his own country where the costs are much much cheaper and his own mother can provide much of the care.
The whole bunch of these freeloaders needs to be sent home.
Wow, this kind of mindset really makes me sick. I'm also glad this family didn't get away with it. It really is b.s. Hopefully this will discourage people from suing the hospitals that take care of them.
Especially in a case like this -- the patient is not acute at all. The family could have paid for him to be in a nursing home or they could have taken him home and taken care of him themselves. Since many of the family are still here and not deported, the only reason the injured man was deported is they didn't arrange to bring him home from the hospital or get him into a long term care facility which they would pay for. Even the hospital in Guatemala knew that he's not in need of acute care services so they released him to his mother's care.
No way should anyone waste tons of limited health dollars keeping a chronic patient in an acute care hospital like it's some free hotel.

I dont think he understood the difference between long term care and acute care. The federal law says we are required to stabalize. However once stabalized, that patient needs to find alternative care, whether paying out of pocket for a care home or sending him back to Guatemala to a care home there.
I was listening to the spanish radio station today and they brought up this case. The majority of the people understood that as an illegal immigrant, their hands are tied and they know they have no right to sue.

I also bet that injured man is doing just fine being cared for by his mother back in his country.
This family had dollar signs in their eyes, apparently they didn't think to sue the drunk driver or the drunk driver didn't have the kind of money they were after so they saw the hospital as the ones with the millions of dollars they hoped to win. They didn't want to see the accident as a tragedy for their loved one but as some kind of jackpot for themselves.
