PHOENIX - Authorities say an undocumented immigrant who drove his truck at a Border Patrol officer has been sentenced to four years in prison.
According to the U.S. Attorney's Office, Luis Alfredo Lopez Sanchez, 38, of Sinaloa, Mexico was sentenced Thursday after previously pleading guilty to assault on a federal officer.
Authorities say that on August 3, 2009, Lopez-Sanchez crossed into the U.S. illegally from Mexico. Four days later he was spotted by a Border Patrol helicopter crew that landed in order to offer medical assistance.
As one of the helicopter crew began to approach, authorities say Lopez-Sanchez ran to his nearby pickup truck, started the engine and accelerated toward the agent.
The agent fired three gunshots in an attempt to divert the truck, then fell to the side at the last moment, sustaining minor injuries.
The helicopter gave chase as Lopez-Sanchez sped away. The suspect eventually drove through a fence, jumped out of the truck and dove into the Santa Cruz River in an effort to get away from agents.
Authorities say when Lopez-Sanchez was found, he resisted arrest and had to be subdued with pepper spray.
"Federal agents put their lives on the line every day to protect our nation's borders by patrolling rough, often hostile terrain, and give assistance to those in distress," said U.S. Attorney Dennis K. Burke. "Assaulting a federal officer will not be tolerated and as Mr. Lopez-Sanchez's sentence shows, it will result in prison time."
He probably HAD been sent back and then tried to come through again.
and you are probably right, I sat on a federal jury about 4 years ago, the guy had returned 3 previous times, had run ins with the law and we couldn't even get a verdict. One a##h@L# said she didn't like or trust cops so she would not vote guilty. We had a hung jury. I do know he was re-tried.
It's unfortunate that the agent who was knocked down missed his target and didn't take the guy out.
When he was captured they should have put a bullet in his head and dropped him back in Mexico. Now we have to pay to jail this POS to the tune of about 40K per year and he'll probably try to sneak in again after his release.

Actually, battery "...is when you slap me.". Assault is the imminent fear of one slapping you.
In the end, the middle-class will end up footing the bill for this miscreant's free stay in the US.
