I recently moved out of my old apartment. The lease ended August 1. On July 27th he was in my apartment on a maintence call and mentioned that if I was going to be staying the rent was going to be going up 40 dollars. I said yes on a whim and he said he would stop by on Sunday (July 29th) to fill out the new lease. I never heard from him Sunday. After the conversation I reevaluated my budget and decided that I could no longer afford that amount of rent. I decided to move out on August 1st and let him know the day before. He got very angry and said I was required to give him at least 60 days notice that I would be leaving. The reason for moving was the rent increase. While I realize I should have called him the moment I decided to leave it still seems strange that I am required to give 60 days notice while he is only required to give me 5 days notice that the rent would be a increasing? He is saying that since I did not give notice that he is keeping the deposit based on the vacant apartment due to my lack of notice.

Ideas?
Advice?

The apartment was left in the same condition I found it. It had old beat up hardwood floor and carpet only in the bedroom so there were no stains. I throughly cleaned it after moving everything out and nothing was damaged

Were you given a lease? Did you sign it?

You may have to chalk this up as a learning experience, but in ill. most landlords want you to sign a lease and that's fine, as long as you have read it and AGREE with it?? If you see something funky, then DO NOT rent the apartment!
Also, if you choose to rent and agree with the lease, TAKE PICS of the apt. the day you receive the keys! Date and time stamp the pics! It's up to you if you wish to make copies for the land lord, but a witness may come in handy too when you take the pics!

You have to see what your lease says about giving notice or not and how many days you have to give notification. That will determine who is out of money - you or he. It might be you.. Better read and see.
