You know that 115 Bourbon Street has somehow already figured out a way to get around this law? Its true. They have some sort of a tent set up 15 feet away from the entrance on the side of the place in the beer garden area. From what I hear from close friends that were there last weekend, there are heaters in this tent and it is like walking into a cloud of smoke once inside there. Now that I am not opposed to this, I actually think they have set a precedent here with a great idea. Their rules are though, that no server is to enter into the area, but you can smoke till your heart's content in there. You have to go to the common bar, get your drink, and since the tent is still in their enclosed fenced in area you are allowed to take your drink back in there. Most businesses in the city will have no way of setting up something like that 15 feet away from the building. It's implausible. The lawmakers in Springfield never thought for one second about how the 15 foot thing would work in the city.

For all intents and purposes, the "15 foot" rule eliminates smoking, even outdoors, in any business district in the city; unless maybe you stand in one of those median flower pots to smoke.

Even as anti-smoking as I am, it seems like that is simply a way to ostensibly "allow" smoking. I can deal with smoking outside--heck, I can even tolerate it at sidewalk cafes--but certainly not inside. I hate feeling like a smoker when I leave a bar since I've been breathing it all night and my clothes smell like it. I might as well one light up! As someone pointed out, 10 years from now people will say, "wow, smoking used to be allowed indoors?!" It's one of those things that slowly progresses across the country like a seatbelt law...

The worst part about the 15 foot rule, correct me if i'm wrong. I don't know the exact letter of the law, is suppose your a business owner and a passerby thats not even one of your customers gets busted smoking within 15 feet of your door.

Dosn't the business owner also have to pay a stiff fine? I know they do if someone inside their establishment gets caught.

Does anyone know if fines apply to the business owner for violations of the 15 foot rule?

This would in effect hold business owners responsible for the actions of those walking down the sidewalk in front of their business.

I can't see any cop no matter how bad of a day he/she had being that big of a D _ _ K head and actually writing up a citation in that case.

Most probably wouldn't, but theire are a few D__Khead cops out there that probably would. Barney Fife comes to mind! LOL
