Unhappy Capital one settlement issue (retraction)

Hi everyone,
i really need some good of advice or atleast someone to point me in the direction of where i can get one. i had 2 accounts with capital 1 i settled both of them on the same day last april 2007. the first one, everything went fine and was settled without a hitch. but the second one ( total each was settled for about 350 divided by 3 payments so approx. 115 each payment) had issues even now. i sent in my payments like usual but still kept getting statements. so i called capt. 1 to find out whats going on and it went on for a while because they kept telling me that my 2nd didn't go through. long story short my bank, capt 1, and i went back and forth to prove that my 2nd and 3rd payments did go through. Then finally one of the associates told me its because who ever took my first payment used my capt 1 credit card to pay off that credit card. so of course it was not approved. Under capt 1 rules, i couldn't use a credit card only check by phone or mail, if a payment is late or denied i would loose the settlement and there was no credit left on that card so it would have been denied anyway. and under capt 1 rule i violated the settlement so i lost it. techincally i have only one 115 payment left and now the charges has accured to almost $1000 b/c i keep trying to find someone to let me just pay the last 115. all the while my credit keeps going down the drain. they kept telling me that i lost the settlement b/c i violated the rules. the latest they told me was that i never even had a settlement with them on that account so now i either settle with them or pay the whole amount...please HELP!!! i just want this off my account and for them to admit their fault and just let me pay my last 115!

It sounds like the employee screwed up and you're paying for it. Go see an attorney. Most will talk free once, or give you a phone consultation free one time. It's can;t hurt.

Did you get it in writting? If so just show them the letter if not I think you might be out of luck. I do not trust anybody verbaly you have to get any deals in writting

unfortunately everything was done on the phone and apparently none of it was logged or recorded so i'm out of luck there.... i wish i DID get it in writting some how.
