We had a realtor show our home without us signing a contract. The family that looked at our house wants to buy it without involving reators. Our neighbor thinks that even though we have not signed a contract, we are obligated by law to still pay the realtor's commission because she showed the house & took pictures. It doesn't make sense since we have not signed anything. Advice anyone???

Um...was the realtor a friend? Are you prepared to lose a friend?

The realtor took time for pictures and posted them. Then acted as your realtor to show the family the house? I would say that is an implied contract and you owe them commission if you sell it to that family she showed the house to. If you don't want the realtor involved before next time, I think you need to basically fire them and have them pull the add and pay them for their time and find your buyer yourself.. I really hate it when people try to get something for nothing and use a business contact to do it. If I were the realtor and found out later, you sold to the couple I showed your house to and didn't pay commission, you might just find yourself in front of a judge. JMHO since I am not a realtor or a realty lawyer.

No signature =no contract=no commission. There is no such thing as an implied contract in real estate and commissions. Even if you had verbally agreed to something, it would not hold up in court. In real estate EVERYTHING must be in writing. This is coming from a former Realtor. That agent can take you to court, but she will lose. The time for her to discuss commission was before she showed the house to her client.

I'm not understanding why the agent took photos. Was your house FSBO? How did the agent know about it?
