I used to read TOS and EULAs until most of them started in with the "we reserve the right to change the terms at any time" and Congress screwed around with the intellectual property laws. Now I just figure that no matter what, no matter how honest I try to be, I'm violating a TOS somehow, and since I don't have a first born son for them to take, and I'm more or less judgment proof and too poor to worry about, they can say what they want. If you disagree, you have the right to arbitration from our team in Outer Mongolia.
If you make stuff too extreme - people will stop even attempting to follow your rules. I can't wait until the drinking limit is lowered (.05 is two drinks in a 180 lb man) and all the two-martini lunch crowd get DUI records and tossed into the slammer after the third arrest. We could wipe out Congress and most of the business community within a year. My only problem will be the idea of being ruled by the department of transportation instead of a real government.
Surprisingly many people DO NOT READ the tos when they register on a site...... Then they end up asking questions later to something they WOULD HAVE KNOWN IF THEY READ THE TOS
I confess! I don't generally read those things, as I notice I get a bad attitude during the reading, lol.
I will say that I did go back and read C-D's TOS after getting into my first little bit of trouble.
I knew already that this is a great site and it was worth the time to find out what not to do here...

Only after a mod docks me points and bars me off the site for X number of games AND I think it was unfair....

I read the TOS for CD, and thought about them a bit, before signing up. I will admit that I don't always read TOS, many of them get meaningless, due to ambiguity of the language used.
I never bother to read them. Same with license agreements.
