What I cannot understand is why some youtube clips from fans of their favorite scenes from movies and tv are still allowed to stay and some are taken down?
Because some copyright holders are OK with their content being available on YouTube and others are not. Fox has its own streaming and cable outlets for "The Simpsons" and it probably views any content posted from the show on YouTube as potentially reducing the audience on those other, more profitable outlets. As the owner of the content, that is the company's right.

I wonder if I should have been proactive, anticipated the shutdown of her account, contacted the simpsons myself and told them what a big fan my daughter is, what she was trying to do and that they are welcome to take any profits. Maybe they would have allowed it to stay?
She really just liked the attention and seeing people like and enjoy the funny moments she shared with them, before this the things she posted got very few views, and when a youtube superstar who's makeup instructional videos she watches and admires liked one of the clips it was very exciting for her and she considered it an honor. The monetization was not really important compared to that.

Copyright is instantaneously conferred upon the creator of any material unless it's a work for hire or contracts are involved. These laws are just as strong for individuals as they are for corporations.
That said there are abuses of the sytem like the "Mickey Mouse Extension" and others like copyright trolls. Those need to be addressed but the fundamental laws of copyright are very sound.

Absolutely not. Enforcement is what confers strength, and no individual has the deep pockets of corporations like Warner - who STILL claims copyright on the "Happy Birthday" song, even though there is documentation that the song is a derivative work of an existing "Good Morning" song.
Also, do not confuse criminal and civil courts. They are two completely separate entities.
Harry while your point about the deep pockets is valid the fact of the matter is copyright is set up to insure those without deep pockets are protected. That's why copyright is granted upon creation.

What gives you the impression I don't know the difference? Copyright is usually a civil matter however it becomes criminal when you have an enterprise that for example is making 1000's of couterfeit discs.

Why should anyone else other than the author make money off of their original content? Copyrights are protected by the Constitution of the United States. Why do you hate America and our ways?
You can make counter claim if you feel you have copyright and sue in civil court.
As with any lawsuit you need to consider if it's worth it. One thing to note, creations that have or are expected to have substantial value are usually registered but that cost money. If the infringement occurs after it's been registered the awarded damages can be substantial.
