Most moderators take things personally and have a power tripping attitude. Nuke runs the place at flamewarriors.net and he is unshakable. You can personally insult the guy all you want and you will never be penalized for it. They've got about 200 or so active members and the place is mostly discussion of current events and rights.

Even a totally-open forum has to watch-for and pull illegal comments/content.

Porn and spam are also frowned upon.....they will usually get pulled in short order.

The DMCA provides for "safe harbor" for service providers; ISP's websites etc. However if you are actively encouraging copyright violations e.g. "The Pirate Bay" you may find yourself facing civil/criminal charges.

One thing to note, in order for the safe harbor provision to apply you need to register.

DMCA only applies to the United States. Copyright laws vary by nation. Owners of forums only have to comply with their local laws.

Oh yes they do.

Copyright violations, illegal content, illegal statement by users, spam, porn. The website can and many times are held responsible for illegal activity on THEIR website.

There's two things going on here. First, not all nations have laws governing such content. There's a concept in law called jurisdiction. Second, criminals don't feel they have to follow the law. That's what makes them criminals. We know that today, there are plenty of unmoderated forums that just exist because no one making the owners do anything about them.

While the Pirate Bay was based overseas pressure from the US played a huge factor. You may be outside of the reach of US law enforcement but you're not outside of the reach of US government influence. If you want another example read up on DVD Decrytpter.
