I used to post on Glurb.com but the attitudes over there was very aggressive, and abusive, so I moved to Iowalink.org I am enjoying most of my time there! We are all working very hard at getting along, and allowing people to be their own unique individual, and learning to be kind, and patient with everyone, we still have our spats, but on the whole we are doing great! We'd love to share with this site, and we can all come, and go between boards.
If you 'd like to learn about some municipal laws that your city officials should apply when you allow them to enforce, construct, and interpret your city policy come join us at Iowalink.org click on "Rhonda's legal" we can share information, and make our sites more interesting! We hope to see you, and we hope you take away some knowledge to use to hold your city representatives responsible so you can challenge cityhall, and make sure the "rule of law" is always applied in your town. People need to learn the importance of getting involved with their government on all issues, and remembering that we have the right, and obligation to be involved in the construction, enforcement, and interpretation of all our policies, and we do not have to be submissive to those we allow to push our pencils! Is this where all of these new posters are coming from? I've noticed an influx of posters in here who only have 10 posts or so, but quite a bit to say about Iowa. (not always good or informative)

Why don't people want to discuss the importance of everyone getting involved in our system? Why do we ignore the fact that once we delegate we fail to regulate, and these failures on our part are allowing those within our very, flawed, complicated ,and indeed dangerous system to disrespect the voices of the people, and abuse the power bestowed upon them.
All this unregulated power we throw around also allows the "Rule of law to be abused! I have seen these abuses first hand and am trying to do my part to hold those within responsible. What are some of your experiences within our system? Have you had anything taken away from you, like your property rights, Constitutional rights, or your dignity, and respect within the eyes of other citizens? Have you been denied equal protection of law etc.? |

My litigation against city of Nevada can only award me damages, but the real solution is for us to totally reform, and abolish the forms of government to which we've become acustomed . And to which we've been forced to suffer under.
Don Juhl, Jerry Gull, Mike Tupper, Dana wipperman, and council members have lied to the citizens, and the first 4 mentioned men misrepresented the facts in court on March 21st. and need to be removed! These men have also tried to make me afraid to envoke my right, and obligation to petition for redress of grievances. Here are some direct quotes from attorney Dario Zaffarano, as entered in court in affidavit form, this is public record now if people want copy. "Over the several years that these matters have been pending, I have also appeared at city council meetings to speak about the city's three animal control ordinances that have been in effect and used against Ms. Appelgate. The history of these ordinances in Nevada has been instructive as an example of how a city can choose to target an individual for the benefit of a complaining neighbor." "Council has treated Ms. Appelgate as a bothersome citizen, who must be tolerated by statute but who can also be ignored. Ms. Appelgate has kept the issue in the news and before the council for over three years now, at significnt financial and emotional expense to herself and her family, because she believes she was wronged. " "I {attorney, Dario Zaffarano} believe that the council allowed itself to become involved in what was initially a dispute between neighbors, and further felt it could not extricate itself without losing face. Even now, the council could reasonably recognize that miniature horses and pot-bellied pigs are owned as pets and should not be treated as livestock or for animal husbandry, and could enact an amendment permitting same without significant damage to the well-being of the citizens of Nevada, if the council chose to do so. Even now, the council could choose to enforce its ordinances against the barking dogs, leash-less cats and livestock being kept in the city." Nevada city officials have been keeping a log on my actions. This log was started, 11/9/04 and last entry is 9/1/2007. Quoted from the log: "Steve Holmes, Story County attorney, stopped at the PD to see me {Mike Tupper,Nevada police chief} and discuss Appelgate's harassment of city staff and city council members over the miniature horse issue. Holmes initially told me that if I needed a legal opinion I should really talk with the city attorney. I pointed out to Holmes that I was looking for an opinion regarding possible State criminal charges and not a violation of a municipal ordinance. Holmes made it clear that he did not feel Appelgate was committing any crimes by sending city staff and council members large amounts of e-mails. Holmes appeared to be defending Appelgate and expressed his concern that city government has treated Appelgate unfairly and his belief that the city's animal code is poorly written. Holmes commented that a miniature horse is clearly not a "beast of burden" and is clearly a pet. Holmes was very vague on what standard he would use to determine if and when the volume of Appelgate's messages went from acceptable to criminal. Holmes tried to state that there would hve to be a threat made and did not want to address the elements of "annoy" and "legitimate purpose" when it comes to communications under 708.7. I had to remind him of these elements. Holmes appeared to be siding with Appelgate on this issue and stated that Appelgate contacts him on a frequent basis. Holmes commented that he does not give her legal advice however." I will type more later, but the county attorney's office would not file criminal charges against me because I was simply envoking my right, and obligation to petition for redress of grievances. Nevada officials are trying to take away all my rights since they have been allowed to wrongfully take my pet, and thru the lies to the court, and people, convince some people to attack me, and destroy my character, and credibility within the eyes of the citizens, and when I ran for office, and to prevent me from doing so again! |
