In short we need a forclosure attorney, we are about to be served forclosure paperwork. Any recomendations would be highly appreciated. Thanks, Scared In Jax

I am a little confused. You want a great foreclosure attorney - but aren't paying your mortgage. If you can afford a great attorney - you can afford to pay your mortgage - no? The Florida Bar has some programs/attorneys etc. to deal with foreclosures. As does JAX Legal Aid. Not sure how good they are. Would be glad to give you some web sites to check out. However - if you have the money to pay an attorney - I suggest you use that money to pay your mortgage first. Also - contact your lender to try to renegotiate your mortgage if you can't afford to pay it. Robyn, Esq.

Robyn, it's not as simple as being able to afford an attorney and being able to afford a mortgage payment. There are all kinds of issues that go into defaulting on a loan and defending a foreclosure action - proper standing, improper notice prior to default, inability to speak with lender about a modification. All of these things can be brought up in litigation and afford the homeowner some type of opportunity to at least mediate, if that is the goal.

ZZTop - I'd recommend contacting Jim Kowalski. My understanding is that he's the best foreclosure defense attorney in Jacksonville that is "for hire" (April Charney I think works through Jax Legal Aid).
