My husband is being to work extra on his personal time off the clock and not be paid. Can he do that?

He can if he is a medical doctor, the extra work is called "Call" and his title is an "Intern, Resident, or Fellow". Otherwise, I would say no.

I'm assuming he is an hourly worker... in which case it is illegal.

Where as salaried employees are a whole 'nother case....

Yeah, if he is salary, then he is not entitled to overtime pay a lot of the time. In public accounting, during "busy season", we work 55 hr weeks required and don't get a dime of overtime pay.

If he is classified as an 'exempt' (from Federal Labor Standards), your husband can be allowed (or required) to work as many hours as is deemed necessary by the requisite individual at your husband's place of employment. If he is classified as "non-exempt" (from Federal Labor Standards) he should be receiving over-time pay as dictated by the Code of Federal Regulations.

Additionally, if your husband is a "non-exempt" employee Worker's Compensation is not required to cover him in case of injury when he is not on the clock. His personal accident/injury/health policy may or may not have any responsibility as that is based upon contractual agreements.

Clearly, it is an "iffy" situation...
